General Terms and Conditions (GTC)
1. Scope and Provider These General Terms and Conditions apply to all orders placed through the online shop of Nothosaur (nothosaur.de). The provider is: Hong Kong Kuren Group Co., Ltd. 2. Conclusion of Contract The product descriptions in the online shop serve as an invitation to submit a purchase offer. By clicking the button "Order with Obligation to Pay" (or "Complete Order"), you place a binding order for the items in your shopping cart. The contract is concluded only when we issue an order confirmation or upon delivery of the goods.
3. Prices and Shipping Costs The prices stated on the product pages include statutory value-added tax (VAT) and other price components. Shipping costs are charged in addition to the stated prices and will be clearly communicated to you in the shopping cart system and on the checkout page. Note for deliveries from non-EU countries: If delivery is made from a warehouse outside the EU (e.g., Hong Kong), additional customs duties, taxes, and fees may apply, which are to be borne by the buyer.
4. Delivery Terms Delivery will be made to the address specified by you. Unless otherwise stated, the delivery time is approximately 7–15 business days for international shipments. All items are shipped in discreet packaging with no indication of the contents on the outside.
5. Terms of Payment Payment can be made via [e.g., Credit Card, PayPal, Klarna]. We reserve the right to exclude specific payment methods.
6. Retention of Title The goods remain our property until full payment has been received.
7. Right of Withdrawal (Cancellation Policy) Consumers are entitled to a statutory right of withdrawal. Details can be found in our separate Cancellation Policy. Special Note: The right of withdrawal expires prematurely for sealed goods that are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery.
8. Warranty (Liability for Defects) Statutory warranty rights apply. Please note that our silicone products are handcrafted, and minor variations in color or texture do not constitute a defect.
9. Limitation of Liability We are liable without limitation for intent and gross negligence. In cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations).
10. Applicable Law and Jurisdiction The laws of the Hong Kong Special Administrative Region apply, to the exclusion of the UN Sales Convention (CISG), provided that mandatory statutory provisions of the country in which the customer has their habitual residence (e.g., Germany) do not conflict with this choice of law.
